1) Acceptance of these Terms
By accessing our website or placing an order, you agree to these Terms and our Return & Refund Policy and Privacy Policy (together, the “Agreement”). If you do not agree, do not use the website.
2) Who can use the website
You must be able to form a legally binding contract and provide accurate information. If you are using the website on behalf of a business, you confirm you have authority to bind that business.
3) Online ordering and legal disclosures
When you order online, you’ll have a chance to review your order details before submitting. After checkout, we provide an order confirmation (and related information) electronically.
Nothing in these Terms removes or limits any rights you may have under applicable consumer protection laws.
4) Products, availability, and substitutions
- Availability: Inventory can change quickly. Items may be unavailable even after you place an order. If an item is unavailable, we may cancel that item and refund it.
- Substitutions (if enabled): If you allow substitutions, you authorize us to substitute with a reasonably comparable product (similar type/quality/size). You can add “no substitutes” notes at checkout.
- Weights/variable items: Some products (e.g., produce) may vary by weight/size. Your final total may adjust based on actual weight.
5) Pricing, taxes, and errors
All prices are in CAD unless stated otherwise. Taxes are applied as required.
If we discover a pricing, description, or system error (including obvious mistakes), we may correct it and either:
- confirm the corrected order with you, or
- cancel and refund the affected item(s) or the entire order.
6) Payment
You authorize us (and our payment processor) to charge your selected payment method for the total shown at checkout, including taxes, delivery fees (if any), and any approved adjustments (e.g., weighed items or substitutions you accepted).
7) Delivery terms
a) Delivery window
Delivery times are estimates. Traffic, weather, and store volume can affect timing.
b) Address and access
You are responsible for providing the correct delivery address and entry instructions (unit number, buzzer, etc.).
c) Contactless / leave-at-door
If you choose “leave at door” or similar instructions, delivery is considered complete once delivered to the location you specify. You accept responsibility for the condition of items after delivery, including temperature exposure.
d) Failed delivery
If delivery fails due to no answer, no safe drop option, incorrect address, inaccessible entry, or inability to contact you, we may return the order to the store. Because many items are perishable, refunds may be limited for those items.
8) Pickup terms
You agree to pick up within the pickup window you selected.
If a pickup order is not collected on time especially for refrigerated/frozen items freshness can’t be guaranteed. Refunds may be limited for perishable items.
9) Returns and refunds
Returns and refunds are governed by our Return & Refund Policy. Because we sell groceries and consumables, many items are non-returnable for food safety reasons, but we will fix issues like wrong/missing/damaged/expired/spoileditems as set out in that policy.
10) Promotions, coupons, and discounts
Promotions may have limits (time, quantity, one per customer/household, etc.). We may refuse or reverse promotional pricing where we reasonably believe there is misuse, fraud, or a technical error.
11) Prohibited use
You agree not to:
- misuse the website (hacking, scraping, interference, or abuse),
- submit false information or impersonate others,
- use the website for unlawful purposes.
12) Privacy
We collect, use, and protect personal information as described in our Privacy Policy.
13) Marketing messages
If you opt in to marketing emails or texts, you can unsubscribe at any time using the link/instructions in the message.
14) Disclaimers
We aim to keep the website accurate and reliable, but it may occasionally contain errors or interruptions. To the fullest extent permitted by law, the website and services are provided “as is” and “as available”.
Nothing in these Terms limits rights you may have that cannot be waived under applicable consumer protection laws.
15) Limitation of liability
To the fullest extent permitted by law, Farah Foods is not liable for indirect, incidental, special, consequential, or punitive damages, or for losses arising from:
- delays or failures outside our reasonable control (weather, outages, traffic),
- misuse of products,
- issues caused by incorrect customer information (wrong address, access issues),
- events after successful delivery (especially with leave-at-door instructions).
Where liability cannot be excluded, it is limited to the amount you paid for the affected order (or the minimum required by law).
16) Indemnity
You agree to indemnify and hold Farah Foods harmless from claims arising out of your misuse of the website, violation of these Terms, or violation of law.
17) Changes to the website or these Terms
We may update the website, products, pricing, and these Terms from time to time. The “Effective date” will change when we do. Continued use after updates means you accept the updated Terms.
18) Governing law
These Terms are governed by the laws of Ontario and Canada, and disputes will be handled in the courts located in Ontario, unless consumer law requires otherwise.
